Oil and Gas Lease Surrenders and Terminations

Has your oil and gas lease expired?  Are you still waiting on surrender or termination documents from the operating company indicating that they no longer have an interest in your property?  Our clients have experienced this problem for years without any efficient recourse.  With the passage of the Recording of Surrender Documents from Oil and Natural Gas Lease Act that became effective December 22, 2014, the Pennsylvania Legislature provided a remedy for landowners who do not receive termination documents in a timely manner.

The Act requires that Lessees deliver to the Lessor, without cost, a surrender document in recordable form not more than thirty (30) days after termination of an oil and natural gas lease.  The Act also provides several steps that landowners can take if they do not receive a recordable termination from the operator within the thirty (30) days.
